By accessing or using HolisticMe ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the App.

2. Description of Service

HolisticMe is a wellness application that provides:

TCM (Traditional Chinese Medicine) constitution assessments
AI-powered food analysis with TCM property insights
Personalized meal planning suggestions based on your wellness profile
Symptom tracking and wellness monitoring
GingerBee AI assistant for health guidance

3. User Accounts

3.1 Using HolisticMe Without an Account

HolisticMe does not require you to create an account to use core features. You can access AI food analysis, symptom tracking, wellness profiles, and other features without providing personal information such as an email address or name.

Your wellness data is stored locally on your device by default. Purchases are managed through Apple App Store or Google Play Store and are linked to your device, not a HolisticMe account.

3.2 Optional Account Creation

In future versions, you may choose to create an account to enable features such as cross-device synchronization or cloud backup. If you create an account, you agree to:

Provide accurate and complete information
Maintain the security of your account credentials
Notify us immediately of any unauthorized access
Be responsible for all activities under your account

3.3 Account Termination

If you have an account, we may suspend or terminate it if you violate these terms or engage in harmful behavior. We may also suspend or terminate accounts to comply with legal obligations or protect the safety and integrity of the service.

4. Subscription and Payments

4.1 Subscription Tiers

Free: Limited food scans, basic symptom tracking, and introductory GingerBee access
Premium: Expanded food scans, AI meal planning, full GingerBee access, grocery cart, and weekly body reports
Premium Plus: All Premium features plus weekly AI wellness reviews, advanced TCM pattern insights, and monthly wellness summaries

4.2 Billing

Subscriptions are billed through Apple App Store or Google Play Store
Subscriptions auto-renew unless cancelled 24 hours before the renewal date
Manage subscriptions in your device's App Store settings

4.3 Refunds

Refund requests are handled by Apple or Google according to their respective policies. Contact their support for refund inquiries.

5. Acceptable Use

You agree not to:

Use the App for any illegal purpose
Share your account with others
Attempt to reverse engineer or hack the App
Upload malicious content or spam
Misrepresent your identity or health information
Use the App to provide medical advice to others

6. Intellectual Property

All content, features, and functionality of HolisticMe are owned by us and protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our permission.

8. Limitation of Liability

HolisticMe is provided "as is" without warranties of any kind
We are not liable for any health outcomes from using the App
To the extent permitted by law, our total liability is limited to the amount you paid for the subscription
We are not responsible for third-party services or content

9. Indemnification

You agree to indemnify and hold harmless HolisticMe from any claims arising from your use of the App or violation of these terms.

10. Changes to Terms

We may update these Terms of Service at any time. Continued use of the App after changes constitutes acceptance of the new terms. We will notify you of significant changes via email or in-app notification.

These terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.
